Description
In criminal prosecutions and sentence enforcement proceedings with a transnational aspect – the suspect/convicted person is present in another Member State or is a national or a resident of another Member State; in both cases, the cooperation by that Member State is needed or, in the future, may be needed to investigate, to prosecute, to judge or to enforce the sentence. Practice shows that there are obstacles to applying the available EU and COE instruments concerning judicial cooperation in a coherent and integrative fashion. Incoherent application of those instruments can be disproportionate and unduly intrusive on fundamental rights, can lead to impunity, can generate unnecessary costs and lead to protracted proceedings and can have a negative impact on mutual trust.
This project will identify possible causes of incoherent application and put forward solutions to remedy incoherent application.
